TikTok and one of its employees sued the administration of US President Donald Trump on Monday, because of his decree of a banning video service transactions in the United States, calling it a reason to incite anti-Chinese rhetoric as he seeks to win the election.
TikTok Company of Culver City, California, and its Chinese parent company ByteDance Ltd is rejected, what they called the White House’s position on the threat to national security, stating that they had taken “emergency measures to protect the privacy and security of TikTok user data in the United States.”
They also mentioned Trump’s call in his decree from August 6 banning TikTok a means of continuing his supposed “broader campaign in line with anti-Chinese rhetoric.” It’s happening on the eve of the November 3 US presidential election, in which Trump is running for a second term.
“We do not take lightly legal action against the government – said TikTok in his blog. – But with a presidential decree, threatening a ban on our operations in the United States … we simply have no choice. ”
TikTok and ByteDance always try to reflect on the execution of Trump’s order from August 6. They claim that the administration of Trump violated their constitutional right due to the process by prohibiting the company without the opportunity for it to answer for these accusations.
They also allege that Trump did not have the proper legal authority to issue the decree, claiming that he abused the law of international emergency economic powers, which allows the president to regulate international trade during a state of emergency in the country.
In May 2019, Trump used the law to stop alleged attempts by foreign telecommunications companies to conduct economic and industrial espionage against the United States.
In a lawsuit filed in federal court of Los Angeles, defendants named Trump and US Secretary of Commerce Wilbur Ross.
Concerning of growing mistrust between Washington and Beijing, Trump has been complaining for weeks, that TikTok is a threat to national security, as the company could share user information with the Chinese government.
His order from August 6 demanded to ban transactions with the application in 45 days.
On August 14, Trump issued a separate order giving ByteDance 90 days to restrict TikTok all transactions in the United States and deprive the company of any data collected by TikTok in the United States.
