EU Court Blocks Hungary’s Aid for Nuclear Power Plant Built by Russia

Austria has won the right to block financing for Hungary’s Paks II nuclear power plant, which is being built by the Russian state corporation Rosatom. This is confirmed by a ruling of the EU Court of Justice.

The EU Court annulled a decision of the EU General Court and declared invalid the European Commission’s approval to provide Hungary with financial aid for the construction of two new nuclear reactors at the Paks II site. The move to block European assistance was initiated by Austria.

Back in 2018, Vienna filed a lawsuit against the European Commission, arguing that it had failed to ensure fair competition.

The Austrian side emphasized that state aid for Hungary’s nuclear project violated the principle of a level playing field within the EU.

In 2022, the lower EU Court dismissed this claim, reasoning that the €12.5 billion subsidy, despite its scale, had not distorted competition rules.

Austria appealed, and now the EU Court has ruled that the Commission could not limit itself to checking compliance with state aid rules. It also had to assess whether the direct awarding of the construction contract for the two reactors without an open tender was lawful.
