The Polish oil and gas concern PGNiG wants to take part in the certification procedure of the Russian Nord Stream-2 gas pipeline.
“PGNiG and PGNiG Supply & Trading have applied for inclusion in the certification process of the Nord Stream-2 gas pipeline operator. The outcome of the review determines whether the pipeline owner will receive a privileged position in the European gas market,” the statement said.
It is specified that PGNiG and its subsidiary PGNiG Supply & Trading have sent a request to the German regulatory authority to participate in the certification of Nord Stream 2 AG, the owner of the Nord Stream-2 gas pipeline.
In Poland, it is believed that Nord Stream 2 AG does not want to comply with the general principles of the III energy package, which aim to ensure competition and a level playing field for all market participants.
“In particular, the owner of Nord Stream 2 wants to avoid the application of laws on ownership distribution, third party access to infrastructure and transparent tariffs that take into account the cost of the entire pipeline. Another important factor is the negative impact of PP-2 on energy security. These arguments should sound, so PGNiG has decided to join the certification procedure, “said PGNiG Chairman Pavlo Maevsky.
It is emphasized that Nord Stream 2 AG, registered in Switzerland, does not meet the main certification criteria.
“According to the gas directive, only a company from an EU member state can be a certified transmission system operator. It must meet clearly defined criteria in terms of corporate structure, which, however, Nord Stream 2 AG does not meet,” PGNiG said.
Pavlo Maevsky believes that there are no legal grounds for issuing Nord Stream 2 AG operator certification, and hence for the launch of the pipeline.
“Nord Stream 2 AG’s application must be rejected for formal and substantial reasons. Security of supply and the proper functioning of the EU energy market are at stake,” he concluded.
