AMCU Fines Companies ₴19 Million for Bid-Rigging in Public Procurement

The Antimonopoly Committee of Ukraine (AMCU) has fined four companies a total of over ₴19 million for engaging in anti-competitive collusion during public procurement tenders, the committee’s press service reported.

On October 2, the AMCU issued two decisions regarding violations of competition law by Hospodar-2 LLC and Demsey PE, as well as Pharmedis LLC and DM-Project LLC. The violations involved coordinated actions that distorted the results of state tenders.

The first case concerned Hospodar-2 LLC and Demsey PE, which participated in tenders for the construction of a pumping station in Pervomaisk and the capital repair of a neurology department at a hospital in the Mykolaiv region. The total expected value of the tenders exceeded ₴34 million.

The investigation found that the companies had coordinated their behavior, exchanged information, and jointly prepared tender proposals, effectively eliminating competition. For these violations, they were fined a total of ₴3,074,937.

The second case involved Pharmedis LLC and DM-Project LLC, which took part in two tenders to supply medical materials for the State Agency for Infrastructure Projects of Ukraine. The companies also acted in concert during the preparation and participation stages to eliminate competition. They were fined ₴16,110,602.

In total, the fines for both cases amounted to more than ₴19 million.
