Dutch Court Seizes Assets of Gazprom Subsidiary

The Amsterdam court has seized the assets of the Dutch company Gazprom Neft Middle East (GNME), a subsidiary of Gazprom Neft, according to Russian media citing court documents.

The lawsuit was filed by investor Alcazar Capital Partners (Cayman Islands), which has been trying for years to recover a debt from the government of Iraqi Kurdistan. The company believes GNME holds property belonging to the Kurdish government that could be used to settle the debt.

Since 2012, GNME has participated in oil and gas exploration and production in the Garmian block in Kurdistan, becoming its operator in 2016.

Alcazar is a subsidiary of Kuwaiti firm Agility, which in 2007 provided a $250 million loan to Korek Telecom under guarantees from the Kurdish government. After the debt went unpaid, a Kuwaiti court in 2022 ordered the Kurdish authorities to pay $490 million. However, in May 2024, a court in Erbil prohibited enforcement of that amount.

Alcazar sought to enforce the Kuwaiti ruling in other countries, including the Netherlands. GNME representatives tried to block the asset seizure by citing various technicalities — for example, claiming that the seizure order was sent to an address where the company no longer had an office — but the court deemed these arguments unfounded and ruled in favor of the seizure.
