The court satisfied the claim of the state-owned PrivatBank to Agroterminal and decided to collect UAH 1 billion in debt from it as a guarantor of Boryvazh. This is stated in the decision of the Commercial Court of Odessa region.
According to court materials, PrivatBank terminated the loan agreement due to the debtor’s breach of its obligations. And Agroterminal noted that the deadline for repayment of the loan, which was set by the loan agreement is November 3, 2026.
The court decided that PrivatBank had rightly exercised its right to send a notice of early termination of the loan agreement.
According to the state register, the founder of Agroterminal is Boryvazh company, the beneficiaries of which are Oleksandr Skotnyk and Narek Budagyan (through Terminal-Yuzhny LLC), Angonas Garofita Nikoleta (through Amertana Holdings LTD), Emmanuel Florentina Arestia (Christon) Investan (through Emanten). Octalensa Holdings LTD).
Boryvazh and Skotarske are also the founders of Agroterminal Logistics, which was a guarantor of Privatbank for refinancing, which the bank attracted from the NBU before nationalization.
The subject of the mortgage was the grain terminal Boryvazh in Odessa region (in the waters of the port of South, the total transshipment capacity – 2 million tons of grain per year), its value, agreed by the parties to the mortgage agreement, amounted to 5.54 billion UAH.
