Association of telecom providers USTelecom will appear in federal court in the case of “net neutrality”

Association of telecom providers USTelecom will appear in federal court in the case of The Major Trade Organization USTelecom, which represents the telecommunication companies in the United States, will speak at the court with a lawsuit, demanding for releasing it from the new “net neutrality” rules in the Internet.

The new rules of the FCC equate Internet to conventional telecommunication channels and oblige providers equally apply to any traffic and not allow discrimination.

The court session will be held on December 4, 2015 and USTelecom (whose members include AT & T and Verizon, and Alamo Broadband Inc.), argues that such rules are blocking the work of suppliers and violate federal laws and the constitution.

The plaintiffs argue that the Federal Communications Commission is wrong because they based  on Chapter 2 of the Law about Communication, which was adopted in 1934, and it’s impractical to regulate it with this document  the  internet space, because this document refers to the telephone connection, and telephone and internet are two different things.

The situation was commented by Richard Bennett, who is the researcher of American Enterprise Institute,  he said that he supports the USTelecom, and said that despite the amendments to the Law about Communications, the document is still not suitable for controlling the Internet space.

A previous attempt by the Federal Communications Commission in the United States to establish a “clean rule” last year was defeated in court. Now the Commission insists that such actions are intended to speed up the network making the Internet more transparent and neutral. Telecommunication systems stated that they are not against the “pure regulations”, but without “suffocating” for their policy.

The court’s decision on the case will be made within 3-6 months.

Barbara Cherry the Professor of Indiana University, was confident that the trial will not be the end of this history, and suggested that if the court support the Commission rules, the Republicans will try to reverse this decision. “This case will wait for the elections in 2016 and then we will see what legislative action will take government on this issue,” – Professor Cherry said.
