Federal Court of the United States filed a criminal charge to a large bank Wilmington Trust Corp. Four former heads of Wilmington Trust Corp. – David Gibson, Robert VA Harrah, William North and Kevin Rakowski are accused of fraud.
Professor of the Delaware University – Charles Elson said that it would be unusual criminal proceeding , as the management of such companies and large financial institutions are rarely held criminally liable on such a scale. Elson also noted that in addition to criminal liability, the bank faces a large amount of the fine, and investors are primarily affected by this , as they are first who have to pay the bills.
The prosecution, which is filed the Wilmington Trust Corp. company , consists of 19 items, including: hiding from federal regulators and shareholders of the amount of overdue loans in the period from October 2009 to November 2010, perjury , fraud.
Prosecutors allege that the bank and its officials concealed the financial condition of the institution during the banking crisis. In 2008, the bank received $ 330 million in its funds, it was one of the first attempts of the federal government to resolve the mortgage crisis. According to prosecutors, the bank was obliged to notify its shareholders about important financial indicators, which would enable investors to make informed decisions.
The accused officials have denied their guilt and promise to fight for their rights in court.
