The AMCU fined 4 dairy enterprises in Khmelnytskyi

The AMCU fined 4 dairy enterprises  in KhmelnytskyiKhmelnytskyi regional territorial office of the Antimonopoly Committee of Ukraine  has fined the privately-operated enterprise “Prometey consulting firm” in the name of the branch “Slavutskyi Butter Plant”, “Ryhalsky factory of the  desiccated milk ” LLC,  “Bimol” LLC, “Biscuit-Milk” LLC for 36.828 thousand UAH for anticompetitive concerted actions in the milk procurement market for industrial processing. 

The Regional territorial office  found that these enterprises, preparing milk in Slavutskyi district, simultaniously reduced the purchase price of milk to 2.50 UAH per 1 kg of base fat milk in May and June 2015.

There were no objective reasons for the simultaneous establishment of business entities of the procurement prices of raw milk at the same level, as the defendants have different specialization of activities and the range of dairy products, the technological conditions of production, the volume of procurement of raw milk, the power and the degree of wear and tear, the prime cost of production of dairy products, ways of its realization (promotion) to customers.

Thus, they could determine the conditions of goods turnover in the market of whole milk for industrial processing, which was purchased from the population on the territory of Slavutskyi  district.

For inappropriate actions  the companies  will pay 36.828 thousand UAH of fine.

“Any changes in the markets of finished dairy products cannot justify the simultaneous establishment by business entities of the  procurement prices of raw milk at the same level. Milk processing plants have not taken sufficient measures to minimize and optimize costs, and to use the mechanism of anti-competitive actions”, – said the head of the Khmelnytskyi regional territorial office of the Antimonopoly Committee of Ukraine,  Vitaly Oluiko.
