The European Commission has fined X €120 million for violating the transparency requirements set out in the Digital Services Act (DSA), according to the Commission’s press service.
The company is accused of using a misleading “blue check” design, maintaining a non-transparent advertising repository, and restricting researchers’ access to public data.
According to the Commission, X allows users to obtain “verified” status without any real verification, which misleads the public and creates risks of fraud.
The platform’s ad repository also lacks essential information about ads and their sponsors, while technical barriers prevent proper analysis of advertising risks.
X further failed to comply with DSA rules on providing researchers access to public data. Its terms of service prohibit even qualified researchers from independently collecting such data, including through scraping. The access procedures include excessive restrictions that prevent studying systemic risks in the EU.
The company has 60 working days to report on measures taken to address the violations, and 90 days to submit an action plan to fix issues with the ad repository and data access. This marks the EU’s first formal finding of non-compliance under the DSA.
