A prerequisite to the beginning of the litigation was an appeal of representatives of the international distributor of Farmat LTD drugs to the State Intellectual Property Service of Ukraine. According to their statement, the designation &#8220;diazolinum&#8221; is common to the whole group of goods of a certain composition, and can not be used as a brand name.<\/p>\n<p style=\"text-align: justify;\">On the eve of December this year, the 5<sup>th<\/sup>, Commercial Court of Kiev\u00a0 rendered the first decision in the present case, prohibiting the company Farmak to transfer intellectual property rights to the marks on the testimony of Ukraine \u21167323, 30054, 31171 and issue licenses for the use of such marks by any person.<\/p>\n<p style=\"text-align: justify;\">Recall that the PSC Farmak is the leading manufacturer of medicines in Ukraine. The company owns about 16% of the Ukrainian pharmaceutical market.
