{"id":21343,"date":"2016-05-04T16:35:51","date_gmt":"2016-05-04T13:35:51","guid":{"rendered":"http:\/\/en.ldaily.ua\/?p=21343"},"modified":"2016-05-04T16:35:51","modified_gmt":"2016-05-04T13:35:51","slug":"the-usa-court-has-forbidden-the-umh-to-use-the-brand-forbes","status":"publish","type":"news","link":"https:\/\/ldaily.ua\/en\/news\/novosti\/the-usa-court-has-forbidden-the-umh-to-use-the-brand-forbes\/","title":{"rendered":"The USA court has forbidden the UMH to use the brand \u201cForbes\u201d"},"content":{"rendered":"<p style=\"text-align: justify;\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-21345 size-medium\" src=\"https:\/\/ldaily.ua\/wp-content\/uploads\/2016\/05\/unnamed-200x200.png\" alt=\"The USA court has forbidden the UMH to use the brand \u201cForbes\u201d\" width=\"200\" height=\"200\" title=\"\"><em>International Court of Arbitration in New York in a dispute between the \u00a0UMH &#8211; the Ukrainian publisher of &#8220;Forbes Ukraine&#8221; magazine, \u00a0and the Forbes Media, LLC American publishing house ruled in favor of the latter on April, 20, and revoked the license of Forbes Ukraine, said in Forbes Media, LLC\u00a0 to the publication L\u0406GA.net<\/em><\/p>\n<p style=\"text-align: justify;\">UMH was forbidden to use the trademark of the publication of Forbes, including &#8220;Forbes Ukraine&#8221;, or any other use of the trademark in print, online resources and mobile applications.<\/p>\n<p style=\"text-align: justify;\">The Court considers as legal the termination of the license agreement of the Forbes Media, LLC with \u00a0UMH because of violations of censorship and principles of independent journalism by the Ukrainian media holding.<\/p>\n<p style=\"text-align: justify;\">Making the decision, the tribunal also referred to violations of the UMH editorial guidelines of the license agreement, stating, that the latter was unable to preserve the integrity and independence of the editorial team of &#8220;Forbes Ukraine&#8221; magazine.<\/p>\n<p style=\"text-align: justify;\">It will be recalled, that in early August 2015 the USA \u00a0government \u00a0imposed the \u00a0sanctions against the owner of UMH Sergiy \u00a0Kurchenko, denying an access to the Forbes TM, its content and domain. Ukrainian Forbes had to move to temporary domain forbes.net.ua, which does not require the trademark ownership.<\/p>\n<p style=\"text-align: justify;\">Then in UMH decided that Forbes Media has violated their rights under the current contract &#8211; a license, according to the Ukrainian holding company, paid until the end of 2018.<\/p>\n<p style=\"text-align: justify;\"><em>January, 13 the online version of the Ukrainian Forbes returned to the old domain forbes.ua. This was decided by the Sadgorskiy court in Chernivtsi in December 2015.
