Kazakhstan will not enforce the ruling of the court of the Astana International Financial Centre<\/span><\/span>, which authorized Ukraine\u2019s Naftogaz to recover $1.4 billion from Russia\u2019s Gazprom. This was stated by Kazakhstan\u2019s Justice Minister Yerlan Sarsembayev<\/span><\/span> in an interview with Zakon.kz<\/span><\/span>.<\/p>\n

\u201cThe Republic of Kazakhstan will not become a transit platform for enforcing decisions that have no legal connection to it. Kazakhstan\u2019s legal mechanisms do not provide for the consideration of disputes unrelated to its jurisdiction, and therefore the AIFC court ruling in question will not be enforced on the territory of Kazakhstan,\u201d Sarsembayev said.<\/p>\n

He added that the order has not yet entered into force and was issued without the participation of the defendant. Gazprom has 14 days to file a motion to overturn the ruling.<\/p>\n

\u201cThis is not a final decision: it is procedural in nature and has not entered into legal force,\u201d the minister explained.<\/p>\n

Although Kazakhstan is a party to the 1958 New York Convention<\/span><\/span>, the minister noted that enforcement of foreign arbitration decisions is regulated by national legislation. He also stated that claims for compulsory enforcement must be filed at the location of the defendant or its assets.<\/p>\n

Earlier, a court in Kazakhstan allowed the recovery of approximately $1.4 billion from Gazprom in favor of Naftogaz. Following that ruling, the Ukrainian company gained the opportunity to seek recovery using Gazprom\u2019s assets in Kazakhstan.<\/p>\n

The dispute between Gazprom and Naftogaz is linked to a 2019 contract for the transit of Russian gas through Ukraine. In June 2025, an international arbitration tribunal in Switzerland ordered Gazprom to pay $1.37 billion to Naftogaz.<\/p>\n

In March, Naftogaz definitively won its legal dispute with Gazprom over the payment of $1.4 billion in gas transit debt.<\/p>\n

The court also ordered the Russian company to pay legal costs amounting to 200,000 Swiss francs and reimburse Naftogaz 250,000 Swiss francs for expenses incurred during proceedings before the Swiss Federal Supreme Court.<\/p>\n

Naftogaz had been responsible for organizing the transit of natural gas through Ukraine for Gazprom until the agreement expired on January 1, 2025. After the start of Russia\u2019s full-scale invasion and the suspension of gas transit through the Sokhranivka entry point, transit operations continued through the Sudzha entry point. Despite this, Gazprom refused to fully pay for gas transportation services, thereby violating its contractual obligations.<\/p>\n

In September 2022, Naftogaz initiated arbitration proceedings against Gazprom. The subject of the arbitration was unpaid fees for organizing the transportation of natural gas through Ukraine, which Gazprom allegedly failed to pay in full and on time.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n
