The President’s Office stated that the decision of the Kyiv District Administrative Court (KDAC) to dismiss NABU Director Artem Sytnyk could not be considered final, as it would be appealed. This was announced on Tuesday, October 27 by the press service of the President’s Office.<\/p>\n
The President also noted that any differences over anti-corruption bodies should not affect the independence of anti-corruption infrastructure. The PO also states that the decision can be appealed, and NABU will continue to function as a full-fledged body.<\/p>\n
“From NABU’s response to such reports, we state that this decision cannot be considered final because it will be appealed. Given the response of Justice Minister Denys Malyuska, we state that NABU has been and remains a fully functioning law enforcement agency.” – it is spoken in the message.<\/p>\n
It is also emphasized that the list of grounds for dismissal of the NABU director is contained in the current legislation. This list can be changed only by a decision of the Verkhovna Rada, not by a court.<\/p>\n
Regarding the decision of the Constitutional Court, which declared some provisions of the Law on the National Anti-Corruption Bureau of Ukraine unconstitutional, the President noted that it was final and not subject to appeal. The PO expects that some provisions of the law will be adjusted in accordance with the Constitution.<\/p>\n
“Regardless of how someone evaluates this decision, there is an objective need for people’s deputies to revise the provisions of the law on NABU, adjusting them to take into account constitutional norms,” the statement said.<\/p>\n
